Terms & Conditions

These Terms & Conditions (“Agreement”) outline the terms under which MWD Pro Design (“we”, “us”, “our”) provides website design, mobile app development, and related services to the client (“you”, “your”). By accepting a quote, making payment, or using our services, you agree to be bound by this Agreement.

Services Provided

We offer professional website and mobile app design and development services, which may include (but are not limited to):

  • Full website builds and mobile app creation

  • Website updates, maintenance, and redesigns

  • E-commerce setup, booking systems, and app store submissions

  • Visual, functional, and performance enhancements

  • SEO setup and optimisation

  • Content additions, accessibility improvements, or technical fixes

Specific deliverables will be outlined in a written quote or proposal. Where applicable, mobile app services may also include the preparation and submission of your app to the Apple App Store and Google Play Store, depending on the package you have selected.

Client Responsibilities

You agree to:

  • Provide all required content, branding assets, business details, and logins in a timely manner.

  • Ensure you have full rights and permissions for all text, images, logos, videos, or third-party tools you supply.

  • Respond to feedback, testing phases, and revision requests promptly.

  • Provide any necessary information for app listings, such as app descriptions, store icons, developer access, or legal disclaimers.

We are not responsible for delays caused by late, incomplete, or incorrect content delivery or communication.

Payments & Pricing

All prices are quoted in GBP (£) and are subject to change without notice.
Full payment is required before work begins unless otherwise agreed in writing.
Custom work beyond the agreed scope will be charged at an additional fixed rate, which will be confirmed in writing prior to starting extra work.
Late payments may result in delayed delivery or temporary suspension of services.

Revisions

All website and app design packages include one round of revisions unless stated otherwise.
Additional revisions may be chargeable and will be quoted separately.
Revision requests must be submitted within 5 days of delivery of the completed work.

Turnaround Times

Estimated project timelines will be provided based on the service selected. Delays may occur due to:

  • Client delays in providing content or feedback

  • Scope changes or late-stage feature requests

  • Third-party or platform-related issues (e.g., app store rejections or review delays)
    We will always keep you informed about changes to the schedule where possible.

Ownership & Licensing

Once full payment is received, you own the final website and/or app design, including any custom assets created by us.
We reserve the right to showcase completed work in our portfolio and promotional materials unless otherwise agreed.
Third-party tools, plugins, images, or content used may be subject to their own licensing terms. You are responsible for ensuring you have any required licences for content or features you ask us to use or install.

Hosting, Domain & App Store

Our packages include the cost of your domain for the first year however, website hosting from the website go-live date, you are responsible for every month, payable to Wix.
We can assist with setup and store connections, but we are not responsible for third-party hosting, email, or domain issues.

Mobile apps built by MWD Pro Design are powered by the Wix Branded App infrastructure. Submission to the Apple App Store and Google Play is included in our mobile app packages, but app store accounts (if required in your name) and associated developer fees are your responsibility.

Approval times for app stores typically range from 1 to 3 weeks. We are not responsible for rejections due to content violations or failure to meet platform guidelines.

Maintenance & Support

Ongoing website or app updates and technical support are not included unless stated in your package or purchased through our After Care Support.
Ad hoc support or one-off changes will be billed according to our current price list or agreed hourly/fixed rates.

Refunds & Cancellations

MWD Pro Design operates a non-refundable policy (see product pages for more information).
If you cancel after work has started, any completed work will be chargeable.
In rare cases where we cannot fulfil a project (e.g., due to prolonged illness or technical limitations), we may issue a partial refund at our discretion.

Liability

While we aim to deliver secure, high-performing websites and apps, we are not liable for:

  • Financial losses due to errors, delays, or technical failures

  • Issues caused by third-party providers or platforms

  • Client misuse, unauthorised modifications, or unmanaged accounts

  • Any loss of revenue, business reputation, or customer data

You are responsible for reviewing your website or app thoroughly before it goes live or is published in any store.

Confidentiality

Both parties agree to keep any sensitive or proprietary information confidential during and after the project, unless disclosure is legally required or agreed in writing.

Client Feedback & Approval

You are responsible for reviewing and approving all work prior to launch or submission.
Once approved, final delivery of a website or app confirms acceptance, and any post-launch changes may be chargeable.

Website & App Security (Wix Platform)

All websites and apps built by MWD Pro Design are hosted and powered by Wix, which provides core security features such as:

  • SSL certificates

  • Secure hosting infrastructure

  • Protection against common cyber threats

You are responsible for account-level security (e.g., passwords, admin access), keeping plugins updated, and reviewing third-party integrations.
We recommend enabling two-factor authentication and performing regular security audits of your site/app settings.

Accessibility & Legal Compliance

Unless requested and specified in writing, we do not guarantee that your website or app will meet WCAG accessibility standards or legal compliance (e.g., GDPR, CCPA, cookie policies).
You are responsible for ensuring your published content, data collection, and user interactions meet applicable regulations.
We can offer guidance on privacy tools (e.g., cookie banners, user consent features) where requested, but compliance is ultimately your responsibility.

Third-Party Services

We may recommend or integrate third-party tools, such as analytics software, booking systems, e-commerce platforms, or email marketing services.
We are not liable for any fees, changes, outages, or failures associated with these services.
You are responsible for maintaining your accounts and complying with their terms of use.

Force Majeure

We are not liable for delays or failure to perform services caused by events outside our control, such as natural disasters, legal changes, platform outages, cyber attacks, illness, or internet/network disruptions.

Amendments

We may update these Terms & Conditions periodically. All changes will be posted on our website or sent to you by email. Continued use of our services implies acceptance of the updated terms.
